User: any natural person who uses the application in accordance with the general conditions of use and whose data is retrieved.

2. PROCESSING PRINCIPLES
Minimization: the collection of data is limited to what is strictly necessary for the intended purpose;
Lawfulness: consent to the collection and processing of data for a specific purpose and the necessity of the collection and processing of data for the performance of a contract;
Information: transparency about how data is collected and processed.
3. DATA COLLECTION AND PROCESSING
3.1. DATA COLLECTION
During installation, commissioning and use by the user, SOMA may collect the following personal data:
Last name
First name
Date of birth
Gender
Height
Weight
General information on physical abilities
Location
3.2. PURPOSE OF DATA PROCESSING
SOMA collects data for the following purposes
Personalization of the user's profile in order to customize the application experience ;
Processing race data to analyze data, view statistics and course data, track progress and goals and offer information and advice ;
the smooth operation and continuous improvement of the application, its services and features;
Management of services provided by SOMA;
Management of requests for access, rectification and opposition, deletion, limitation, portability, right to digital death and filing a complaint with the French Data Protection Authority (Commission Nationale Informatique et Libertés) ;
Commercial solicitation, which may take the form of e-mail or postal mail, SMS, telephone call or targeted online advertising.
Where data has been collected in connection with the provision of a service or inquiries, information on similar or targeted services or inquiries based on previous requests may be sent, unless the data subject requests or objects to no longer receiving such commercial communications. This data is kept for marketing purposes for a maximum period of three (3) years from the date of collection.
Each time an electronic communication is sent for commercial prospecting purposes, the recipient has the option of choosing not to receive it in the future by means of an unsubscribe link. In addition, it is possible, at any time, to send an e-mail to the following address: contact@ikines.is to request that you no longer wish to receive these commercial communications.
The use of data and information as described above is authorized by applicable data protection regulations.
4. CONSENT
All data concerning the User is collected solely and directly from the User, during the various interactions with the Application, after obtaining the User's prior consent.
5. DATA RECIPIENTS
Only the authorized and specified persons listed below will have access to User data:
Authorized staff of the various SOMA departments;
Third-party social networks.
SOMA will not share, trade, sell or rent the data collected to any other person mentioned above.
6. DATA RETENTION PERIOD
SOMA undertakes to keep the data collected in a form that allows the user to be identified for no longer than is necessary for the purposes for which the data is collected and processed.
However, data may be processed for the purpose of proving a right or contract. Data may also be kept for the purpose of complying with a legal obligation, or kept in files in accordance with applicable laws and regulations.
By way of exception, user identification data is kept for a period of three (3) years from the last contact with the user in order to manage the relationship with the user and to ensure the follow-up of this relationship.
After this period, the data is archived.

8. USER RIGHTS
The user has the following rights:
Right of access, rectification, updating and completion of data;
Right to block or delete personal data that is inaccurate, incomplete, ambiguous, out of date, or whose collection, use, communication or storage is prohibited;
Right to withdraw consent at any time;
Right to limit data processing;
Right to object to data processing;
Right to portability of data provided, where my data is subject to automated processing based on consent or contract;
Right to lodge a complaint with the Commission Nationale Informatique et Libertés.
These rights may be exercised on simple request by e-mail or by post to SOMA's addresses, indicating your contact details (surname, first name, address, and a copy of a signed identity card) and a legitimate reason when required by law, in particular in the event of opposition to processing.
9. UPDATING OF PRIVACY POLICY
SOMA reserves the right to modify this Privacy Policy at any time in order to provide updated information on how data is collected and processed, particularly in the event of the addition of products, services and applications, improvements to the Application, and in accordance with technological and regulatory developments.
If such modifications are significant and if required by applicable law, the user's authorization will be required. Such notice of modification will be published on the Application and/or sent by e-mail.
